Terms of use — TrackDayR Competitive Hub

1. The service and who runs it

The Competitive Hub (“the Hub”) is a companion website and installable app for the game TrackDayR. It shows leaderboards, rankings, official events and rider profiles based on the game's results. It is operated by MadCow srl, Piazza Martiri della Libertà, 31 – 27036 Mortara (PV), Italy, VAT number IT02815500182 (“we”). Using the Hub is free. By using it you accept these terms.

2. Accounts

You sign in with your Steam account; signing in does not by itself confirm ownership of the game. You are responsible for the security of your Steam account. The Hub is meant for people who may hold a Steam account; if you are under 14, ask a parent or guardian before signing in. You can delete your Hub account at any time from Settings.

3. Results and fair play

Official results are produced by the game and published in its Steam leaderboards; the Hub only displays them and cannot be used to submit or change results. Cheating, modified or unofficial versions of the game and the use of bugs to gain an advantage are not allowed. The TrackDayR team may remove such results from the game's leaderboards — and therefore from the Hub — and may exclude the riders concerned from rankings and official events. Reports and disputes about results can be sent to ale@trackdayr.com; the TrackDayR team decides on official results, without prejudice to your statutory rights.

4. Players' names

The Hub shows the public results of all players, with the name and avatar of their Steam profile. Players who do not want to appear can object as described in section 3 of the privacy notice.

5. Notifications and the installable app

Notifications and installation on your device are optional and can be switched off at any time. They depend on your browser and on its maker's push service: they may arrive late or, occasionally, not at all. Always check the Hub or the game for anything time-critical, such as the end of a tournament.

6. Acceptable use

  • Do not attempt to disrupt, overload or gain unauthorised access to the service, and do not try to manipulate results, rankings or other players' data.
  • Do not access the Hub with automated means (bots, scrapers, bulk downloads) without our written permission. Normal use of the site and of the installed app is of course allowed.
  • Do not use the Hub to impersonate other players or for any unlawful purpose.

We may limit or block access that breaks these rules.

7. Names, logos and content

The TrackDayR name, logos, images and the Hub's design belong to MadCow srl or its licensors. You may view and share pages of the Hub for personal, non-commercial purposes; any other use needs our written permission. Steam and the Steam logo are trademarks of Valve Corporation; the Hub is not affiliated with or endorsed by Valve.

8. Availability and changes to the service

The Hub is provided free of charge and “as is”. Data come from Steam and may be delayed, incomplete or temporarily unavailable. We may change, suspend or discontinue features, or the whole service, at any time; where reasonable we will announce important changes on the Hub.

9. Liability

As far as the law allows, we are not liable for damages arising from the use of, or the inability to use, the Hub — including delayed or incorrect data and notifications that are late or not delivered — except in cases of intent or gross negligence, and except for any liability that cannot be excluded by law (including the mandatory rights of consumers). Nothing in these terms limits the rights you have as a consumer under the law of your country of residence.

10. Governing law and courts

These terms are governed by Italian law. If you are a consumer, you also keep the protection of the mandatory rules of the country where you live, and disputes are handled by the courts of your place of residence or domicile as provided by law. In all other cases the courts of Pavia, Italy, have exclusive jurisdiction.

11. Changes to these terms

We may update these terms. We will publish the new version on this page with its date and announce important changes on the Hub; changes apply from their publication and do not affect anything that happened before.
